1. TERMENI SI DEFINITII
TotVerde.com reprezentat de Max Access SRL cu sediu social in Jud. Ilfov, Chiajna, Str. General Eremia Grigorescu nr.31, avand numar de ordine in Registrul Comertului J23/1895/2004, cod unic de inregistrare fiscala RO17020916.
Vanzator – TotVerde.com
Cumparator – persoana fizica / persoana juridica sau orice entitate juridica care isi face un Cont in Site si efectueaza o Comanda.
Client – persoana fizica / persoana juridica care are sau obtine acces la CONTINUT, prin orice mijloc de comunicare pus la dispozitie de catre TotVerde.com (electronic, telefonic, etc) sau in baza unui acord de utilizare existent intre TotVerde.com si acesta si care necesita crearea si utilizarea unui CONT.
Utilizator – orice persoana fizica/juridica inregistrata pe Site , care, prin finalizarea procesului de creare a Contului, si-a dat acordul cu privire la clauzele specifice site-ului din sectiunea Termeni si Conditii Generale.
Cont – sectiunea din Site formata dintr-o adresa de e-mail si o parola care permite Cumparatorului transmiterea Comenzii si care contine informatii despre Client/Cumparator si istoricul Cumparatorului in Site (Comenzi, facturi fiscale, garantii Bunuri, etc.).
Site – domeniul www.TotVerde.com si subdomeniile acestuia.
Comanda – un document electronic ce intervine ca forma de comunicare intre Vanzator si Cumparator prin care Cumparatorul transmite Vanzatorului, prin intermediul Site-ului intentia sa de a achizitiona Bunuri si Servicii de pe Site.
Contract – reprezinta contractul la distanta incheiat intre Vanzator si Cumparator, fara prezenta fizica simultana a Vanzatorului si a Cumparatorului.
Continut
• toate informatiile de pe Site care pot fi vizitate, vizualizate sau altfel accesate prin utilizarea unui echipament electronic;
• continutul oricarui e-mail trimis Cumparatorilor de catre Vanzator prin mijloace electronice si/sau orice alt mijloc de comunicare disponibil;
• orice informatie comunicata prin orice mijloc de catre un angajat/colaborator al Vanzatorului, Cumparatorului, conform informatiilor de contactare, specificate sau nu de catre acesta;
• informatii legate de Bunurile si/sau Serviciile si/sau tarifele practicate de Vanzator intr-o anumita perioada;
• informatii legate de Bunurile si/sau Serviciile si/sau tarifele practicate de catre un tert cu care Vanzatorul are incheiate contracte de parteneriat, intr-o anumita perioada;
• date referitoare la Vanzator, sau alte date privilegiate ale acestuia.
Recenzie – o evaluare scrisa de catre detinatorul sau beneficiarul unui produs sau serviciu, evaluare redactata pe baza experientei personale si capacitatii acestuia de a realiza comentarii calitative și de a spune daca produsul sau serviciul respecta sau nu specificatiile mentionate de catre producator.
2. DOCUMENTE CONTRACTUALE
Prin inregistrarea unei Comenzi pe Site, Cumparatorul este de acord cu forma de comunicare (telefonic sau e-mail) prin care Vanzatorul isi deruleaza operatiunile comerciale.
Notificarea primita de catre Cumparator, dupa efectuarea Comenzii are rol de informare si nu reprezinta acceptarea Comenzii. Aceasta notificare se face electronic (e-mail) sau telefonic.
Pentru motive justificate, Vanzatorul isi rezerva dreptul de a modifica cantitatea Bunurilor si/sau Serviciilor din Comanda. Daca modifica cantitatea de Bunuri si/sau Servicii din Comanda va anunta Cumparatorul la adresa de e-mail sau la numarul de telefon puse la dispozitia Vanzatorului la efectuarea Comenzii si va returna suma achitata.
Contractul se considera incheiat intre Vanzator si Cumparator in momentul primirii de catre Cumparator de la Vanzator, prin intermediul postei electronice si/sau SMS a notificarii de expediere a Comenzii.
3. COMANDA
Clientul/Cumparatorul poate efectua Comenzi pe Site, prin adaugarea Bunurilor si/sau Serviciilor dorite in cosul de cumparaturi, urmand a finaliza Comanda efectuand plata prin una dintre modalitatile indicate . Odata adaugat in cosul de cumparaturi, un Bun si/sau un Serviciu este disponibil pentru achizitie in masura in care exista stoc disponibil pentru aceasta. Adaugarea unui Bun/Serviciu in cosul de cumparaturi, in lipsa finalizarii Comenzii, nu atrage dupa sine inregistrarea unei comenzi, implicit nici rezervarea automata a Bunului/Serviciului.
Prin finalizarea Comenzii Cumparatorul consimte ca toate datele furnizate de acesta, necesare procesului de cumparare, sunt corecte, complete si adevarate la data plasarii Comenzii.
Prin finalizarea Comenzii, Cumparatorul consimte ca Vanzatorul poate sa il contacteze, prin orice mijloc disponibil / agreat de Vanzator, in orice situatie in care este necesara contactarea Cumparatorului.
Vanzatorul poate anula Comanda efectuata de catre Cumparator, in urma unei notificari prealabile adresate Cumparatorului, fara nicio obligatie ulterioara a vreunei parti fata de cealalta sau fara ca vreo parte sa poata sa pretinda celeilalte daune-interese in urmatoarele cazuri:
-neacceptarea de catre banca emitenta a cardului Cumparatorului, a tranzactiei, in cazul platii online;
-invalidarea tranzactiei de catre procesatorul de carduri agreat de TotVerde.com, in cazul platii online;
-datele furnizate de catre Client/Cumparator, pe Site sunt incomplete si/sau incorecte;
Cumparatorul are dreptul sa se retraga din Contract, respectiv sa returneze un Bun sau sa renunțe la un Serviciu, în termen de 14 zile calendaristice, fara invocarea niciunui motiv si fara a suporta alte costuri decât cele de livrare.
Astfel, potrivit OUG nr 34/2014, perioada de returnare a unui Bun sau renunțare la un Serviciu expiră în termen de 14 zile de la:
– ziua în care Cumparatorul intră în posesia fizică a ultimului Bun – în cazul în care Cumparatorul comandă printr-o singură comandă produse multiple care vor fi livrate separat
– ziua în care Cumparatorul intră în posesia fizică a ultimului Bun sau a ultimei piese – în cazul livrării unui produs care constă din mai multe loturi sau piese,
In cazul in care Cumparatorul decide sa se retraga din Contract, acesta va contacta telefonic sau prin email Vanzatorul si isi va expira dorita de a returna bunurile, urmand ca Vanzatorul sa ii comunice procedura de retur.
In cazul in care Clientul/Cumparatorul solicita retragerea din Contract in cadrul termenului legal de retragere din contract, trebuie sa returneze si eventualele cadouri care au insotit produsul respectiv. In cazul in care Comanda este achitata, Vanzatorul va rambursa suma in maxim 14 (paisprezece) zile de la data informarii Vanzatorului de catre Cumparator asupra deciziei sale de retragere din Contract. Suma va fi returnata dupa cum urmeaza:
-pentru Comenzile achitate cu card online/ordin de plata -> prin restituire in contul din care a fost efectuata plata;
-pentru Comenzile achitate ramburs -> prin virament bancar in contul beneficiarului din factura;
Vanzatorul va putea amana rambursarea sumei pana la primirea Bunurilor vandute sau pana la primirea unei dovezi conform careia acestea au fost expediate, in cazul in care nu s-a oferit sa recupereze el insusi Bunurile (se va lua data cea mai recenta).
In cazul in care un Bun si/sau Serviciu comandat de catre Cumparator, nu poate fi livrat de catre Vanzator, acesta din urma va informa Clientul/Cumparatorul asupra acestui fapt si va returna in contul Cumparatorului contravaloarea Bunului si/sau Serviciului, in termen de maxim 7 (sapte) zile de la data la care Vanzatorul a luat la cunostinta acest fapt sau de la data la care Cumparatorul si-a exprimat in mod expres intentia de reziliere a Contractului.
In orice situatie de returnare a produselor, acestea trebuie sa fie in aceeasi stare in care au fost trimise clientului, in ambalajul original, cu etichetele intacte si impreuna cu toate documentele care l-au insotit. Produsele returnate trebuie sa fie in aceeasi conditie ca la primire, nu trebuie sa prezinte modificari fizice, socuri, lovituri, zgarieturi, urme de folosire si/sau interventii neautorizate. (cu exceptia viciilor ascunse si exceptand defectele deja semnalate de client in corespondenta cu noi). Neindeplinirea acestor conditii poate duce la refuzul returului din partea noastra.
In eventualitatea in care produsul achizitionat este nefunctional sau prezinta vicii de fabricatie, acesta va fi inlocuit cu un produs functional, cu conditia notificarii in scris in termen de 14 zile de la primirea produsului.
Toate taxele de transport aferente returului sunt suportate de catre client .
Conform legislatiei in vigoare politica de retur a produselor se aplica numai pentru achizitiile facute de persoane fizice. PFA-urile și persoanele juridice nu beneficiază de dreptul de retur în 14 zile.
4. GARANTII
Pentru produsele achizitionate se asigura garantie 24 luni (persoane fizice), 12 luni (persoane juridice).
Preluarea produselor pentru garantie, cade in sarcina firmei de curierat Fan Courier. Nu suntem raspunzatori pentru coletele nepreluate de la clienti din diverse motive (clientul nu raspunde la telefon, clientul nu poate fi gasit la adresa, clientul nu are produsul in momentul in care este contactat de catre agentul Fan Courier, etc.). In aceste cazuri, pentru solutionarea garantiei, clientul trebuie sa expedieze produsul printr-o firma de curierat la adresa Jud. Ilfov, Chiajna, Str. General Eremia Grigorescu nr.31, Max Access SRL sau sa il aduca personal la adresa. Nu suntem raspunzatori pentru daunele provocate de societatile de curierat asupra produselor expediate. Este necesar ca produsele sa fie ambalate corespunzator si expediate prin societati de curierat ce pot manipula corect coletele. Este recomandat ca produsele cu o greutate de peste 30kg sa fie expediate pe palet. Costurile tur-retur pentru expeditia coletului vor fi suportate integral de catre client.
Condiţiile de garanţie se acordă în conformitate cu O.G. 21/1992, Legea 449-2003 şi Legea 296/2004, cu modificările şi completările ulterioare, şi nu limitează, ignoră sau restricţionează direct sau indirect drepturile legale ale cumpărătorului, aşa cum sunt prevăzute de lege. Durata garantiei este stipulata pe factura fiscala, Max Access SRL va asigura garanţia produselor comercializate conform garantiilor producatorilor, prin reparare sau, în cazul în care acestea nu se mai pot repara, se vor înlocui conform prevederilor legale în vigoare, în 30 zile de la data înregistrării reclamaţiei clientului. Înlocuirea se poate face cu un produs identic / similar sau cu unul cu parametrii tehnico-calitativi superiori.
Montarea, instalarea, configurarea subansamblelor reprezintă o activitate care presupune calificare profesională și nu o activitate de bricolaj sau care poate fi efectuată de persoane neautorizate. Cumpărătorul care o face totuși, își asumă riscul deteriorării produselor și pierderea garanției. În cazul utilizării garanției, produsul va fi însoțit de factură fiscală a produsului, certificatul de garanție al produsului, de factură fiscală pentru montajul produsului de către o firmă atestata ANRE, de proces verbal de punere în functiune (PIF), Buletin / Certificat PRAM, pentru excluderea deteriorării produsului de către o firmă/persoană neautorizată.
Max Access SRL nu răspunde de problemele de compatibilitate cu produsele achiziţionate de la alte firme si nu isi asumă nici o răspundere pentru subansamblele care sunt folosite pe sisteme ce nu îndeplinesc specificaţiile tehnice cerute de producătorul respectiv.
5. LIVRAREA
Data estimata de livrare poate varia in functie de produs, si este comunicata prin e-mailul sau telefonul de confirmare a comenzii.
Pentru produsele aflate in stoc, livrarea se va face prin curier . Intre inregistrarea comenzii si preluarea acesteia de catre curier exista un interval de 1-6 ore. Orice intarziere suplimentara va fi comunicata clientului si se va agrea cu acesta un nou termen de livrare care nu va putea depasi termenul maxim prevazut mai sus.
In cazul in care un produs este indisponibil vom informa clientul despre indisponibilitate .
La solicitarea noastra sau a curierului, clientul va face dovada identitatii sale, daca e necesar prin una sau mai multe acte emise de autoritati oficiale si va comunica numarul de comanda atribuit de catre vanzator.
In cazul in care clientul se afla in imposibilitatea receptionarii comenzii in mod personal, comanda va fi lasata la adresa precizata doar unei persoane cu varsta mai mare de 18 ani si doar in cazul comunicarii catre curier, a numarului comenzii.
In cazul livrarii la locul de munca al clientului, caz in care curierul nu poate avea acces in locatia respectiva, clientul trebuie sa se asigure ca poate receptiona aceasta comanda.
Clientul va fi contactat telefonic de catre curier in prealabil pentru a obtine confirmarea prezentei acestuia la adresa si ora selectate in momentul validarii comenzii pe site.
Clientul se obliga sa fie prezent la adresa de livrare indicata, in intervalul orar selectat, in caz contrar acesta va suporta taxa de transport aferenta unei posibile noi livrari. Intervalul orar va putea fi modificat, ulterior selectarii, doar cu acordul curierului.
Livrarea se considera a fi indeplinita de catre noi, la momentul predarii produselor comandate catre client la adresa selectata de acesta la momentul plasarii comenzii.
6. RECEPTIA PRODUSELOR
Clientul se obliga sa semneze bonul de livrare (AWB) prezentat de catre curier la livrarea produselor comandate.Deasemenea, clientul are posibilitatea de a deschide coletul inaintea platii daca a optat pentru aceasta varianta si de a verifica daca produsele sunt deteriorate sau daca exista lipsuri, iar eventualele probleme vor fi mentionate in mod olograf pe bonul de livrare, pentru a putea fi luate in considerare.
Prin semnarea bonului de livrare clientul recunoaste primirea in bune conditii si in totalitate a produselor comandate.
Mentiunile cu privire la eventualele probleme privind integritatea/continutul unor colete se fac in momentul livrarii, sau se intocmeste un proces verbal de constatare, se refuza primirea si plata coletului. Orice reclamatii ulterioare, cu privire la aceste aspecte, sunt nule.
7. RASPUNDERE
Nu suntem responsabili pentru daunele la adresa utilizatorilor sau a partilor terte ca rezultat al incapacitatii de a utiliza serviciile si/sau produsele noastre sau ca rezultat direct, indirect al acestui fapt. Nu suntem responsabili pentru daune de orice fel pe care cumparatorul le poate suferi ca rezultat al indeplinirii de catre Vanzator a oricarei din obligatiile sale conform Comenzii si pentru daune care rezulta din utilizarea Bunurilor dupa livrare si in special pentru pierderea acestora. Prin urmare, utilizarea produselor noastre este la discretia dumneavoastra si pe propriul risc. Sunteti unic responsabil/responsabila de orice daune la adresa dumneavoastra.
Prin continuarea utilizarii site-ului TotVerde.com, intelegeti si sunteti de acord in mod expres cu faptul ca utilizarea site-ului TotVerde.com, a serviciilor si produselor noastre este realizata pe propriul risc.

Terms and Conditions
1. TERMS AND DEFINITIONS
TotVerde.com represented by Max Access SRL with registered office in Ilfov County, Chiajna, 31 General Eremia Grigorescu Street, with serial number in the Trade Register J23/1895/2004, unique fiscal registration code RO17020916.
Seller – TotVerde.com
Buyer – natural person / legal person or any legal entity that creates an Account on the Site and places an Order.
Client – natural person / legal entity who has or obtains access to the CONTENT, through any means of communication made available by TotVerde.com (electronic, telephone, etc.) or based on an existing user agreement between TotVerde.com and it and which requires the creation and use of an ACCOUNT.
User – any natural/legal person registered on the Site, who, by completing the Account creation process, has agreed to the site-specific clauses in the General Terms and Conditions section.
Account – the section on the Site consisting of an e-mail address and a password that allows the Buyer to submit the Order and which contains information about the Client/Buyer and the Buyer's history on the Site (Orders, tax invoices, Goods guarantees, etc.).
Website – the domain www.TotVerde.com and its subdomains.
Order – an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, through the Site, his intention to purchase Goods and Services from the Site.
Contract - represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
Content
• all information on the Site that can be visited, viewed or otherwise accessed using an electronic device;
• the content of any e-mail sent to Buyers by the Seller by electronic means and/or any other available means of communication;
• any information communicated by any means by an employee/collaborator of the Seller, the Buyer, according to the contact information, whether or not specified by the latter;
• information related to the Goods and/or Services and/or the rates charged by the Seller in a certain period;
• information related to the Goods and/or Services and/or the rates charged by a third party with whom the Seller has concluded partnership contracts, in a certain period;
• data relating to the Seller, or other privileged data of the latter.
Review – an evaluation written by the owner or beneficiary of a product or service, an evaluation written based on personal experience and their ability to make qualitative comments and to say whether or not the product or service meets the specifications mentioned by the manufacturer.
2. CONTRACTUAL DOCUMENTS
By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller conducts its commercial operations.
The notification received by the Buyer after placing the Order is for information purposes only and does not constitute acceptance of the Order. This notification is made electronically (e-mail) or by telephone.
For justified reasons, the Seller reserves the right to change the quantity of the Goods and/or Services in the Order. If it changes the quantity of the Goods and/or Services in the Order, it will notify the Buyer at the e-mail address or telephone number provided to the Seller when placing the Order and will return the amount paid.
The contract is considered concluded between the Seller and the Buyer upon receipt by the Buyer from the Seller, via e-mail and/or SMS, of the notification of shipment of the Order.
3. ORDER
The Customer/Buyer can place Orders on the Site by adding the desired Goods and/or Services to the shopping cart, and then finalizing the Order by making the payment through one of the indicated methods. Once added to the shopping cart, a Good and/or a Service is available for purchase to the extent that there is stock available for it. Adding a Good/Service to the shopping cart, in the absence of the Order being finalized, does not entail the registration of an order, nor the automatic reservation of the Good/Service.
By completing the Order, the Buyer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true on the date of placing the Order.
By completing the Order, the Buyer consents that the Seller may contact him, by any means available/agreed upon by the Seller, in any situation in which it is necessary to contact the Buyer.
The Seller may cancel the Order placed by the Buyer, following prior notification to the Buyer, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other in the following cases:
-non-acceptance by the issuing bank of the Buyer's card of the transaction, in the case of online payment;
-invalidation of the transaction by the card processor approved by TotVerde.com, in the case of online payment;
-the data provided by the Client/Buyer, on the Site are incomplete and/or incorrect;
The Buyer has the right to withdraw from the Contract, respectively to return a Good or to renounce a Service, within 14 calendar days, without invoking any reason and without incurring any costs other than delivery costs.
Thus, according to GEO no. 34/2014, the period for returning a Good or waiving a Service expires within 14 days from:
– the day on which the Buyer takes physical possession of the last Good – if the Buyer orders multiple products in a single order that will be delivered separately
– the day on which the Buyer takes physical possession of the last Good or the last part – in the case of delivery of a product consisting of several lots or parts,
If the Buyer decides to withdraw from the Contract, he will contact the Seller by phone or email and will expire his wish to return the goods, following which the Seller will communicate the return procedure.
If the Customer/Buyer requests withdrawal from the Contract within the legal withdrawal period, he/she must also return any gifts that accompanied the respective product. If the Order is paid, the Seller will refund the amount within a maximum of 14 (fourteen) days from the date the Buyer informs the Seller of his/her decision to withdraw from the Contract. The amount will be refunded as follows:
-for Orders paid with online card/payment order -> by refund to the account from which the payment was made;
-for Orders paid on delivery -> by bank transfer to the beneficiary's account on the invoice;
The Seller may postpone the reimbursement of the amount until receipt of the Goods sold or until receipt of proof that they have been shipped, if he has not offered to recover the Goods himself (the latest date will be taken).
In the event that a Good and/or Service ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Client/Buyer of this fact and will return the value of the Good and/or Service to the Buyer's account, within a maximum period of 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed his intention to terminate the Contract.
In any situation of returning products, they must be in the same condition in which they were sent to the customer, in the original packaging, with intact labels and with all accompanying documents. The returned products must be in the same condition as upon receipt, must not show physical changes, shocks, blows, scratches, traces of use and/or unauthorized interventions. (except for hidden defects and excluding defects already reported by the customer in correspondence with us). Failure to meet these conditions may result in our refusal to accept the return.
In the event that the purchased product is non-functional or has manufacturing defects, it will be replaced with a functional product, provided that written notification is given within 14 days of receiving the product.
All shipping costs related to the return are borne by the customer.
According to the legislation in force, the product return policy applies only to purchases made by individuals. PFAs and legal entities do not benefit from the 14-day return right.
4. GUARANTEES
For purchased products, a 24-month warranty (individuals), 12-month warranty (legal entities) is provided.
The collection of products for warranty is the responsibility of the Fan Courier courier company. We are not responsible for packages not collected from customers for various reasons (the customer does not answer the phone, the customer cannot be found at the address, the customer does not have the product when contacted by the Fan Courier agent, etc.). In these cases, to resolve the warranty, the customer must ship the product through a courier company to the address Jud. Ilfov, Chiajna, Str. General Eremia Grigorescu no. 31, Max Access SRL or bring it personally to the address. We are not responsible for damage caused by courier companies to the shipped products. It is necessary that the products be properly packaged and shipped through courier companies that can handle the packages correctly. It is recommended that products weighing over 30kg be shipped on a pallet. The round-trip costs for shipping the package will be fully borne by the customer.
The warranty conditions are granted in accordance with OG 21/1992, Law 449-2003 and Law 296/2004, as subsequently amended and supplemented, and do not limit, ignore or restrict directly or indirectly the legal rights of the buyer, as provided by law. The duration of the warranty is stipulated on the tax invoice, Max Access SRL will ensure the warranty of the products sold according to the manufacturers' warranties, by repair or, if they can no longer be repaired, they will be replaced according to the legal provisions in force, within 30 days from the date of registration of the customer's complaint. The replacement can be made with an identical / similar product or with one with higher technical and qualitative parameters.
The assembly, installation, configuration of subassemblies is an activity that requires professional qualification and is not a DIY activity or that can be performed by unauthorized persons. The buyer who does it, however, assumes the risk of product damage and loss of warranty. In the case of using the warranty, the product will be accompanied by a fiscal invoice for the product, the product warranty certificate, a fiscal invoice for the assembly of the product by an ANRE-certified company, a commissioning report (PIF), a PRAM Bulletin / Certificate, to exclude product damage by an unauthorized company / person.
Max Access SRL is not responsible for compatibility issues with products purchased from other companies and assumes no liability for subassemblies that are used on systems that do not meet the technical specifications required by the respective manufacturer.
5. DELIVERY
The estimated delivery date may vary depending on the product, and is communicated via e-mail or phone call confirming the order.
For products in stock, delivery will be made by courier. There is an interval of 1-6 hours between the registration of the order and its receipt by the courier. Any additional delay will be communicated to the customer and a new delivery term will be agreed with him, which cannot exceed the maximum term provided above.
In the event that a product is unavailable, we will inform the customer about the unavailability.
At our or the courier's request, the customer will provide proof of his/her identity, if necessary by one or more documents issued by official authorities, and will communicate the order number assigned by the seller.
If the customer is unable to receive the order in person, the order will be left at the specified address only to a person over 18 years of age and only if the order number is communicated to the courier.
In the case of delivery to the customer's workplace, in which case the courier cannot have access to the respective location, the customer must ensure that he/she can receive this order.
The customer will be contacted by telephone by the courier in advance to obtain confirmation of his/her presence at the address and time selected when validating the order on the site.
The customer undertakes to be present at the indicated delivery address, within the selected time slot, otherwise he/she will bear the transport fee for a possible new delivery. The time slot may be modified, after selection, only with the courier's consent.
Delivery is considered to be completed by us at the time of delivery of the ordered products to the customer at the address selected by the customer at the time of placing the order.
6. RECEIPT OF PRODUCTS
The customer is obliged to sign the delivery note (AWB) presented by the courier upon delivery of the ordered products. The customer also has the option to open the package before payment if he has opted for this option and to check if the products are damaged or if there are any shortages, and any problems will be mentioned in writing on the delivery note, so that they can be taken into account.
By signing the delivery note, the customer acknowledges the receipt of the ordered products in good condition and in full.
Any concerns regarding the integrity/content of packages are reported at the time of delivery, or a report is drawn up, and the package is refused receipt and payment. Any subsequent complaints regarding these issues are void.
7. LIABILITY
We are not liable for damages to users or third parties as a result of the inability to use our services and/or products or as a direct, indirect result of this. We are not liable for damages of any kind that the buyer may suffer as a result of the Seller's performance of any of its obligations under the Order and for damages resulting from the use of the Goods after delivery and in particular for their loss. Therefore, the use of our products is at your own discretion and risk. You are solely responsible for any damages to you.
